Agreement to Terms
By accessing our website, scheduling a service, or otherwise engaging with the Company, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you should not use our website or services. We reserve the right to update or modify these terms at any time without prior notice. Your continued use of our services following any changes constitutes acceptance of those changes.
Services Description
We provide junk removal, property cleanouts, hauling, and related waste disposal services for residential and commercial customers. Our services include, but are not limited to, furniture removal, appliance removal, estate cleanouts, apartment cleanouts, garage cleanouts, construction debris removal, yard waste removal, and general junk hauling. The scope of each job is determined based on the information provided by the customer and confirmed upon on-site assessment.
Scheduling and Cancellation Policy
Appointments can be scheduled through our website, by phone, or by text message. We will confirm your appointment date and arrival window in advance. If you need to reschedule or cancel an appointment, please notify us at least 24 hours before the scheduled service time. Failure to provide adequate notice may result in a cancellation fee. We reserve the right to reschedule appointments due to weather conditions, vehicle issues, or other circumstances beyond our control, and we will notify you as soon as possible if a reschedule is necessary.
Pricing and Payment
All prices quoted prior to an on-site assessment are estimates only and are not binding. The final price will be confirmed on-site after our team evaluates the volume, weight, type, and accessibility of the items to be removed. You will be informed of the final price before any work begins, and work will only proceed upon your approval. Payment is due in full upon completion of the service. We accept cash, credit cards, debit cards, and other payment methods as indicated at the time of service. Additional charges may apply for items that require special handling, excessive weight, or difficult access conditions.
Liability and Limitations
Once items have been removed from your property, the Company assumes no liability for those items. It is your responsibility to clearly identify and separate all items you wish to keep before our team begins work. We are not responsible for any items that are inadvertently removed if they were not clearly separated or identified by you prior to service. We are not liable for damage to items that have been designated for removal. Our total liability for any claim arising from our services shall not exceed the total amount you paid for the specific service giving rise to the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to our services. We provide our services on an “as-is” and “as-available” basis, and we make no warranties or representations regarding the timeliness, completeness, or accuracy of our services beyond what is expressly stated in these terms.
Prohibited Items
For the safety of our team and compliance with local, state, and federal regulations, we cannot accept the following items:
- Hazardous materials and toxic substances
- Chemicals, solvents, paints, and pesticides
- Medical waste, syringes, and pharmaceuticals
- Asbestos-containing materials
- Radioactive materials
- Explosive or flammable materials
- Biological waste
- Automotive fluids (oil, gasoline, antifreeze, brake fluid)
- Batteries (certain types)
- Propane tanks and pressurized cylinders
If prohibited items are discovered during the removal process, we reserve the right to leave those items and adjust the scope of service accordingly. It is your responsibility to disclose the presence of any hazardous or prohibited materials before service begins. Failure to do so may result in additional charges or termination of the service.
Property Access and Safety
You are responsible for providing safe and reasonable access to the items to be removed. This includes ensuring clear pathways, adequate lighting, and informing us of any known hazards on the property such as uneven surfaces, low-hanging obstructions, or aggressive animals. The Company is not liable for pre-existing property conditions, including but not limited to damaged walls, floors, doorframes, driveways, or landscaping. If our team determines that conditions on-site are unsafe, we reserve the right to decline or modify the scope of the job.
You represent and warrant that you are the legal owner of the items to be removed, or that you have obtained proper authorization from the owner to dispose of such items. The Company shall not be held liable for the removal of items you did not have the authority to dispose of.
SMS/Text Messaging Consent
By providing your phone number, you consent to receive automated text messages (SMS) and phone calls from us, including appointment confirmations, reminders, promotional offers, and service updates. Message and data rates may apply. You may opt out at any time by replying STOP to any message. Message frequency varies. Opting out of text messages will not affect your ability to use our services, but you may need to contact us by phone or email for appointment-related communications.
Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of the Company or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.
Termination
We reserve the right to refuse or terminate service to any customer at our sole discretion, including but not limited to situations involving unsafe conditions, prohibited items, abusive behavior toward our staff, or failure to pay for services rendered. You may cancel your service relationship with us at any time by contacting us directly.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in the State of New York.
